  • Brazil is a Currency Controlled Country, which means it has a Central Bank that controls the exchange market. Therefore, landlords and many providers will not accept payments from abroad, since they will have to pay high taxes. Landlords may accept rent payments in a foreign bank account.

 

  • Receiving money in Brazil can be problematic if you do not have paperwork to identify why funds are being received.

 

  • The local documentation needed are the work visa, CPF, RNM & CPTS (needed forpayroll).

 

  • An assignee will need a CPF in order to connect.

 

  • To open a bank account they will need the RNM, CPF, proof of income, proof of residency, and passport.

 

  • Traffic is a big concern in the metropolitan cities of Brazil. Public transportation is usually not recommended with the exception of the metro in São Paulo.

 

  • Public schools are not recommended in Brazil, assignees chose private schools, however there are limitations in the availability in the private schools, primarily in the American and British schools.

 

  • Many cities have both 110 and 220 voltages, depending on which city the assignee is relocating to.

 

  • In Brazil, most rental properties do not come with stoves, refrigerators, toilet seats or ceiling lamps, this is something we need to negotiate in each lease as needed.

 

  • The walkthrough inspection in Brazil is called Vistoria and it must be made part of the lease agreement by law.

 

  • Security is a big concern in Brazil. Unlike many other places, the underprivileged areas (Favelas) are often very close to or intermingled within most expat.

 

  • Termo de distrato is the document that is signed once a lease agreement has been ended upon Departure, very specific to each as it details the final agreement made with the Landlord to return the property.

 

  • If a company (Pessoa Juridica) signs a lease, they will most likely need to declare the rent as an expense. This will also means that the Landlord needs to declare the rent payment as income and will need to pay a 27.5% tax, which is added to the rent amount. However, this can be avoided if the payment to the landlord comes from an individual (Pessoa Fisica) as opposed to a company.

 

  • One of the biggest concerns with regards to the 27.5% income tax if the lease is in the company’s name and they pay the rent is that often Landlords and/or companies are not aware of this.

 

  • It is common practice that rental agreements are for 30 months; however rent is increased yearly as per the market index agreed on the lease (IGP-M orIPC)

 

  • In some cases, if the landlord agrees, the lease can be negotiated for less than 30

 

 

  • Per Brazil’s tenancy law, the tenant is allowed to terminate the lease by providing 30-day notice due to work related reasons. Therefore, the Diplomatic Clause does not need to be added additionally to the lease

 

  • To cancel a lease, 30 days notice is already part of the tenancy law if the tenant is relocating outside of the city due to work related reasons. If the lease is cancelled for any other reason other than relocation, there is a 3 month penalty (reduced proportionally based on the time lived in theapartment).

 

  • 3 Types of guarantees in lieu of Corporation signing as guarantor:
    • Insurance Bond (Seguro Fianza) – through insurance companies
    • Title of Capitalization.
    • Advance PaymentGuarantee.

 

  • Rent is usually paid in arrears however; landlords often ask that the first month’s rent be paid in advance because the landlord needs to pay the rental commission; which is usually one month’s rent.

 

  • In some cases, landlords may ask for fire insurance to be obtained and paid for by the

 

  • Utilities remain in the landlord’s name in most locations, but the tenant is responsible for payment.

 

  • The areas where affordable, desirable rentals are most likely to be located within Sao Paulo are, Vila Nova Conceição, Alto da Boa Vista, Morumbi, Moema, Brooklin, Vila Olímpia, Itaim Bibi, Jardins, Paraiso, Higienópolis, and In Rio de Janeiro the areas are, Ipanema, Leblon, Barra de Tijuca, Lagoa, Jardim Botanico, some areas of Copacabana, and Botafogo.
